These Terms of Service (“Terms”) govern your access to and use of pencestry.com (the “Site”) and any purchases made through the Site. By using the Site or placing an order, you agree to these Terms.
About Pencestry
The Site is operated by Pencestry (“we”, “our”, “us”). Our products are designed, machined, engraved, and finished as described on the Site.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase on the Site.
Orders
When you place an order, you agree that the information you provide is accurate and complete. We reserve the right to refuse or cancel an order at any time for reasons including, but not limited to: suspected fraud, unauthorized payment, errors in pricing or product information, or concerns related to policy compliance.
Limited Releases
Some designs are offered for a limited time or in limited quantities. Once a release closes, it may not return.
Pricing and Payment
Prices are shown in U.S. dollars unless otherwise stated. Taxes and shipping fees (if applicable) are calculated at checkout. Payment is processed through our checkout provider. We do not store full payment card information on our servers.
Personalization
Personalized engraving is created based on the information you submit. You are responsible for reviewing your message for accuracy before placing your order.
We reserve the right to refuse personalization requests that violate our Personalization / Engraving Policy or that we reasonably determine to be inappropriate, unlawful, or inconsistent with the brand’s intended use.
Production, Shipping, and Lead Time
Many of our products are made to order. Estimated production and shipping timelines are provided on the product page and/or at checkout, but are not guaranteed. Lead time may vary based on order volume, customization, and materials availability.
Risk of loss and title pass to you upon delivery to the carrier (unless otherwise required by law). Please ensure your shipping address is correct before completing checkout.
Returns and Exchanges
Due to the custom nature of personalized products, personalized items are generally final sale and are not eligible for return or exchange except where required by law.
Non-personalized items may be eligible for return subject to our Returns & Warranty Policy.
Warranty
Our warranty terms are described in our Returns & Warranty Policy. In general, we stand behind defects in materials and workmanship under normal use, and we may repair or replace items at our discretion.
Warranty coverage does not include normal wear, patina changes, cosmetic damage, accidental damage, misuse, or modifications.
Product Care and Use
Our products are made from durable metals and are intended for normal use as writing instruments. To preserve finish and function, avoid dropping the pen, exposing it to harsh chemicals, or storing it in damp environments for extended periods.
Intellectual Property
The Site and its content, including text, photographs, graphics, logos, product designs, and layout, are owned by or licensed to Pencestry and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.
User Content and Submissions
If you submit content to us (including personalization text, messages, reviews, or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for the purpose of fulfilling your order and operating and improving our services. We will not publish private personalization messages publicly without your permission, except where the content is already public or required by law.
Disclaimers
The Site and products are provided “as is” and “as available,” to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted or error-free.
Product images and previews are intended to represent overall appearance and placement. Because engraving and finishing are physical processes, minor variations may occur.
Limitation of Liability
To the fullest extent permitted by law, Pencestry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Pencestry from and against claims, damages, liabilities, and expenses arising from your misuse of the Site, violation of these Terms, or violation of any law or rights of a third party.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except where prohibited by applicable law.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
